Drug crimes include, but are not limited to, the following:

First-degree Controlled Substance

This is a felony and you may be sentenced to up to 30 or 40 years in prison and/or to payment of a fine up to $1,000,000, depending on the specific offense:

  • selling 17 grams or more of cocaine or methamphetamine, or
  • selling 10 grams or more of cocaine or methamphetamine AND possessing or using a firearm, or
  • selling 10 grams or more of heroine, or
  • selling a mixture containing 50 grams or more of amphetamine, phencyclidine, hallucinogen, or a narcotic other than cocaine, methamphetamine, and heroine, or
  • selling a mixture containing 25 kilograms or more marijuana or tetrahydrocannabinols, or
  • possessing 50 grams or more of cocaine or methamphetamine, or
  • possessing 25 grams or more of cocaine or methamphetamine AND possessing or using a firearm, or
  • possessing 25 grams or more of heroin, or
  • possessing 500 grams or more of amphetamine, phencyclidine, hallucinogen, or a narcotic drug other than cocaine, heroin, or methamphetamine, or
  • possessing 50 kilograms or more of marijuana or Tetrahydrocannabinols, or 500 or more marijuana plants.

Second-degree Controlled Substance

This is a felony level offense and you may be sentenced to up to 25 or 40 years in prison and/or to payment of a fine no more than $500,000.

  • selling 10 grams or more of a narcotic drug other than heroin, or
  • selling 3 grams or more of cocaine or methamphetamine AND possessing or using a firearm, or
  • selling 3 grams or more of heroin, or
  • selling 10 grams or more of amphetamine, phencyclidine, or hallucinogen, or
  • selling 10 kilograms or more of marijuana or Tetrahydrocannabinols, or
  • selling any amount of a Schedule I or II narcotic drug to a person under the age of 18, or using a person under the age of 18 to unlawfully sell the substance, or
  • selling in a school zone, a park zone, a public housing zone, or a drug treatment facility, or
  • possessing 25 grams or more of cocaine or methamphetamine, or
  • possessing 10 grams or more of cocaine or methamphetamine AND possessing or using a firearm, or
  • possessing 6 grams or more of heroin, or
  • possessing 50 grams or more of amphetamine, phencyclidine, hallucinogen, or a narcotic drug other than cocaine, heroin, or methamphetamine, or
  • possessing 25 kilograms or more of marijuana or Tetrahydrocannabinols, or 100 or more marijuana plants.

Third-degree Controlled Substance

This is a felony and you may be sentenced to imprisonment for no more than 20 years and/or to payment of a fine that is no more than $250,000.

  • selling any narcotic drug, or
  • selling 10 or more dosage units of phencyclidine or hallucinogen, or
  • selling a controlled substance classified in Schedule I, II, or III, except a Schedule I or II narcotic drug, to a person under the age of 18, or
  • using a person under the age of 18 to unlawfully sell a controlled substance listed in Schedule I, II, or III, except a Schedule I or II narcotic drug, or
  • selling 5 kilograms or more of marijuana or Tetrahydrocannabinols, or
  • possessing 10 grams or more of a narcotic drug other than heroin, or
  • possessing 3 grams or more of heroin, or
  • possessing 50 or more dosage units of a narcotic drug, or
  • possessing any amount of methamphetamine, amphetamine, a schedule I or II narcotic drug or five or more dosage units of lysergic acid diethylamide (LSD), 3,4-methylenedioxy amphetamine, or 3,4-methylenedioxymethamphetamine in a school zone, a park zone, a public housing zone, or a drug treatment facility, or
  • possessing 10 kilograms or more of marijuana or Tetrahydrocannabinols.

Fourth-degree Controlled Substance

This is a felony-level offense, and to be convicted means that you could be sentenced to up to 15 years in prison and/or to payment of a fine up to $100,000.

  • selling a controlled substance classified in Schedule I, II, or III, except marijuana or Tetrahydrocannabinols, or
  • selling a controlled substance classified in Schedule IV or V to a person under the age of 18, or
  • using a person under the age of 18 to unlawfully sell a controlled substance classified in Schedule IV or V, or
  • selling any amount of marijuana or Tetrahydrocannabinols in a school zone, a park zone, a public housing zone, or a drug treatment facility, except a small amount for no remuneration, or
  • possessing ten or more dosage units of phencyclidine or hallucinogen, or
  • possessing a controlled substance classified in Schedule I, II, or III, except marijuana or Tetrahydrocannabinols, with the intent to sell it.

Fifth-degree Controlled Substance

A fifth-degree controlled substance crime carries a sentencing of up to 5 years in prison and/or a fine of up to $10,000.

  • selling marijuana or tetrahydrocannabinols, except a small amount of marijuana for no remuneration, or
  • selling a controlled substance classified in Schedule IV, or
  • possessing a controlled substance classified in Schedule I, II, III, or IV, except a small amount of marijuana, or
  • procuring, attempting to procure, or possessing a controlled substance through fraud, deceit, misrepresentation, or other similar means.
